The terms and conditions for using myclever AI — your rights, our responsibilities, and how the service works.

1. Introduction
These Terms and Conditions govern your use of the myclever AI platform operated by myclever AI, a company registered in England and Wales. By accessing or using our service, you agree to be bound by these terms in accordance with UK law.
2. Definitions
- "Service" refers to the myclever AI platform, including all features, tools, and functionalities.
- "User" refers to any individual or business entity that creates an account and uses the Service.
- "Company", "We", "Us" refers to myclever AI.
- "Connected Data" refers to business data accessed through integrations you authorise.
3. Account Registration
To use myclever AI, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access
- Ensuring your account information remains current and accurate
4. Subscription Plans & Payment
myclever AI offers subscription-based access with the following terms:
- Free Trial: 14-day free trial period for new users
- Billing: Subscriptions are billed monthly or annually in your local currency (GBP, USD, or CAD)
- Payment: Processed securely through Stripe
- Cancellation: You may cancel at any time; access continues until the end of the billing period
- Refunds: We do not offer refunds for partial subscription periods
Plan Entitlements
- Core Plan 3 tool connections, 1 active goal, 1 user seat, weekly action plans
- Pro Plan 8 tool connections, 3 active goals, 3 user seats, on-demand action plans, 100% private data
- Scale Plan 20 tool connections, 10 active goals, 5 user seats, on-demand action plans, team features, priority support, 100% private data
Active Goal Policy
Each plan includes a limit on the number of concurrent active goals. An "active goal" is any goal currently being tracked for AI-generated insights and action plans. Goals that are completed or archived do not count toward your active goal limit.
- Goal Activation: Creating a new goal or reactivating an archived goal counts as an activation
- Edit Window: You have 15 minutes after activating a goal to edit its details without using additional activation credits
- Courtesy Swap: Once per billing cycle, you may replace an active goal even if you have reached your limit
- Completing Goals: Marking a goal as complete frees up a slot for a new goal
- Archiving Goals: Archived goals do not count toward your active goal limit
To increase your active goal limit, upgrade to a higher plan. Plan changes take effect immediately.
5. Data Usage & Privacy
Your data is handled according to your chosen subscription plan. These terms constitute binding contractual commitments:
Core Plan
Anonymised business data may be used for aggregate benchmarking insights to improve industry-wide analytics. All personally identifiable information is removed before any such use. Your data helps improve insights for the myclever AI community.
Pro & Scale Plans - Contractual Privacy Guarantee (Binding Commitment)
myclever AI contractually commits to Pro and Scale Plan subscribers that:
- Your data will never be used to train AI models We will not use your data to train, improve, or develop any artificial intelligence or machine learning models
- Your data will never be used for benchmarking We will not include your data in any aggregate analytics, benchmarking, or industry reports
- Your data will never be shared with third parties Beyond service providers who process data solely to deliver the service to you
This guarantee is equivalent to enterprise-grade privacy commitments such as ChatGPT Enterprise. Breach of this commitment entitles you to terminate your subscription and receive a pro-rata refund.

6. Third-Party Integrations
myclever AI connects to third-party services (e.g., Xero, Shopify, HubSpot) to provide insights. By connecting these services:
- You authorise myclever AI to access data from these services on your behalf
- You confirm you have the right to grant such access
- You understand we are not responsible for the availability or accuracy of third-party services
- You may disconnect integrations at any time through your account settings
7. AI-Generated Insights
myclever AI uses artificial intelligence to generate business insights and recommendations. You acknowledge that:
- AI-generated insights are suggestions and should not replace professional business advice
- We do not guarantee specific business outcomes from following recommendations
- You are solely responsible for business decisions made based on our insights
- The accuracy of insights depends on the quality and completeness of your connected data
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Share your account credentials with others
- Resell or redistribute access to the Service
- Use automated systems to access the Service without permission
- Interfere with the proper functioning of the Service
9. Intellectual Property
The myclever AI platform, including its design, features, and content, is owned by myclever AI and protected by UK and international intellectual property laws. You retain ownership of your business data. We grant you a limited, non-exclusive licence to use the Service for your internal business purposes.
10. Limitation of Liability
To the maximum extent permitted by UK law, myclever AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
Either party may terminate this agreement:
- You may cancel your subscription at any time through your account settings
- We may suspend or terminate accounts that violate these terms
- Upon termination, your right to access the Service ends immediately
- You may request deletion of your data in accordance with UK GDPR
12. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
